The Art Ally website (”Website”) and Art Ally services (“Services”) are developed and maintained by Elizaveta Bomash (“Service provider”).
This Terms of Use Agreement (“Agreement”) is entered into by and between Elizaveta Bomash, an individual (“Service Provider,” “I,” “me,” or “myself”) and the user (“User,” “you,” or “your”) of the services provided by the Service Provider through the Art Ally website.
By accessing or using my services, you agree to comply with and be bound by the following terms and conditions. If you do not agree to these terms, please do not use my services.

1. Description of Services
I, as the Service Provider, offer introductions via e-mail, introductions via e-meeting, cooperation project management, and evaluation support services on my website.
2. User Registration
In order to access certain services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
3. Fees and Payment Terms
I reserve the right to charge the fees for certain services, such as introductions with artists for businesses. When you use a service that has a fee, you have an opportunity to review and accept the fees that you will be charged.
Unless otherwise stated, all fees are quoted in Euro (EUR).
I reserve the right to change the fees from time to time in my sole discretion.
In order to process your payment of the fee or a donation, I use Stripe, a third-party payment processor.
Your payment will be processed by Stripe, who collect, use and process your information, including payment information, in accordance with their privacy policies. You can access their privacy policy via the following link: https://stripe.com/gb/privacy
Stripe’s services in Europe are provided by a Stripe affiliate—Stripe Payments Europe Limited (“Stripe Payments Europe”)—an entity located in Ireland. In providing Stripe Services, Stripe Payments Europe transfers personal data to Stripe, Inc. in the US.

Legal basis for processing: necessary to perform a contract (Article 6(1)(b) of the General Data Protection Regulation).
The reason why necessary to perform a contract: to fulfil your contractual obligation to pay for the goods or services you have ordered from us.
4. User Responsibilities
a. You are responsible for maintaining the confidentiality of your account and password.
b. You agree to use the services for lawful purposes and in compliance with all applicable laws and regulations.
c. You agree not to engage in any activity that could harm or interfere with the proper functioning of the website or services.
5. Privacy Policy
My privacy policy, available on the website, outlines how your personal information is collected, used, and disclosed. By using my services, you consent to the collection and use of your information as described in the privacy policy.
6. Termination
I reserve the right to terminate or suspend your account and access to the services at my sole discretion, without notice, for any reason, including if you violate these terms.
7. Refund Policy
a. For the users of the paid services, the refund is available in accordance with the conditions outlined below. If, within a period of six (6) months from the date of payment, I am unable to find a suitable match for you in accordance with the agreed-upon services, you are eligible for a full refund.
b. To request a refund, you must submit a written request to hello@artally.net within seven (7) days of the expiration of the six-month period.
c. I will review the request and, if the failure to find a suitable match is confirmed, will process a full refund to the original payment method within thirty (30) days of receiving the refund request.
d. This refund policy applies solely to the inability to find a suitable match within the specified timeframe and does not apply to any other circumstances or reasons for termination of services.
e. The donations are non-refundable.
8. Disclaimer of Warranties
The services are provided “as is” and “as available” without warranties or guarantees of any kind, either express or implied. I do not warrant that the Art Ally services will be uninterrupted, uncorrupted, timely, or error-free. I am not responsible for any content, code or any other imprecision.
I reserve the right to make additions, deletions, or modifications to the contents of the services at any time without prior notice.
9. Limitation of Liability
To the fullest extent permitted by law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
10. Governing Law
This Agreement is governed by and construed in accordance with the laws of Finland. Any legal action or proceeding arising out of or related to this Agreement shall be brought exclusively in the courts of Finland, and you consent to the jurisdiction of such courts.
11. Changes to Terms and Refund Policy
I reserve the right to update or modify these terms, the refund policy, and any other provisions of this Agreement at any time without prior notice. Such amendments will be effective immediately upon the posting of the amended Terms and Conditions on this website. Continued use of the website and services after any such changes shall constitute your consent to such changes.
12. Entire agreement
These Terms of Use supersede all previous conditions, understandings, commitments, agreements and representations whether oral or written.
They constitute the entire agreement between the parties, relating to the subject matter of these Terms and Conditions.
